In no event shall Foundation For Culinary Arts, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract.  Foundation for Culinary Arts, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Additionally, Foundation for Culinary Arts does not endorse and is not responsible for the accuracy or reliability of statements made by third parties.

  1. REFUNDS, RETURNS OR LOSSES

Donations and purchases of ticket sales are nonrefundable and are considered the property of Foundation for Culinary Arts upon the successful transfer of funds either by cash, credit card, stock, material or immaterial goods.  Additionally, Foundation for Culinary Arts may not be held liable for certain kinds of losses that may occur.

  1. INDEMNIFICATION

You hereby indemnify to the fullest extent Foundation for Culinary Arts from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

  1. USER CONTENT

All software, material, information, communications, text, graphics, links, electronic art, animations, audio, video, photos, and other data which are uploaded or otherwise made available within the Website are referred to collectively as “Content”. Any Content that you independently develop (or otherwise own) and upload or otherwise make available in the Website (“User Content”) is and remains your sole property or the property of your licensors. However, by uploading or otherwise making available any User Content:

  • you automatically grant, and/or warrant that the owner has granted, Foundation for Culinary Arts, the perpetual royalty-free, non-exclusive right and license to use, reproduce, modify, publish, distribute, perform, display and transmit the User Content on the Website; and
  • you automatically grant any other user of the Website the right to access, view, store and reproduce the User Content in connection with their use of the Website. Foundation for Culinary Arts is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

  1. ASSISGNMENT

The Foundation for Culinary Arts is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

  1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between Foundation for Culinary Arts and you in relation to your use of this Website, and supersede all prior agreements and understandings.

  1. GOVERNING LAW & JURISDICTION

These Terms will be governed by and interpreted in accordance with the laws of the State of Illinois, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Illinois for the resolution of any disputes.
